These Terms of Service ("Terms") govern your access to and use of the website blacknode.store ("Site") and the digital products and services offered by BLACKNODE ("we", "us", "our"). By using the Site or purchasing any product, you accept these Terms.

1. About BLACKNODE

BLACKNODE is an online retailer of digital automotive software products including, but not limited to, ECU tuning suites, IMMO OFF tools, checksum correction utilities and diagnostic databases. All products are delivered electronically. Contact: focuslocalaiagency@gmail.com · Telegram.

2. Eligibility

You must be at least 18 years old and have legal capacity to enter into a contract. By placing an order you confirm you meet these requirements.

3. Orders and payment

All payments are processed by Stripe. Prices are displayed in EUR including any applicable VAT. Your payment data is handled by Stripe; BLACKNODE never receives or stores your card details. An order is confirmed once Stripe authorizes the charge.

4. License and use of software

Each product purchased grants you a personal, non-transferable, non-exclusive license to install and use the software on the equipment you operate professionally, unless the product page states otherwise. You may not resell, sublicense, redistribute, decompile or reverse-engineer the software outside what is allowed by applicable law.

You are responsible for using the software in compliance with the laws applicable in your jurisdiction, including any regulations relating to vehicle modifications, emissions and roadworthiness.

5. Delivery

Products are delivered electronically by email and Telegram, typically within 15 minutes of payment confirmation. If you have not received your delivery within a reasonable time, contact us so we can resend the link.

6. Refunds and right of withdrawal

Because our products are downloadable digital goods that are made available to you immediately upon payment, the EU right of withdrawal under Directive 2011/83/EU may not apply once the download has begun. Refund handling is described in our Refund Policy.

7. Warranties and disclaimer

Software is provided "as is" without warranty of any kind. While we test every product before listing, we cannot guarantee that it will be error-free, compatible with every hardware setup, or fit a specific purpose. You assume responsibility for the use of the software on your bench and on customer vehicles.

8. Limitation of liability

To the maximum extent permitted by law, BLACKNODE is not liable for indirect, consequential, incidental or punitive damages, including but not limited to loss of profit, data, business or vehicle damage, arising out of the use or inability to use any product. Our aggregate liability is limited to the amount you paid for the relevant product.

9. Intellectual property

All site content, branding and product descriptions are the property of BLACKNODE or its licensors. Third-party trademarks (WinOLS, ALLDATA, KESS, KTAG, MPPS, etc.) are the property of their respective owners and are referenced only for identification.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date. Continued use of the Site after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the European Union and the country of incorporation of BLACKNODE. Disputes will be resolved in the competent courts of that jurisdiction, without prejudice to mandatory consumer protection rules in your country of residence.
